Which System Are You In? Check Your Paperwork

If you were stopped for impaired driving in Alberta, the single most important thing to determine is which system you are in, because there are two, and they run on completely different rules. Some people are in both.

Immediate Roadside Sanctions

Alberta's provincial system. No criminal charge, but immediate licence consequences, and a review that must be filed within 7 days. Barring exceptional circumstances, late applications will not be heard, and the adjudicators are unforgiving on timelines.

We conduct the IRS reviews and the judicial reviews. When the deadline is apparent from the consult, the review is filed before it. Every time.

Criminal Impaired, Over .08, or Refusal

The criminal courts, with different procedures and different stakes: mandatory minimum fines, driving prohibitions, the ignition interlock program, and a permanent criminal record on conviction.

Disclosure in a criminal file is nothing like an IRS record. Our lawyers review both kinds daily and know what to look for in each.

The disclosure in an Immediate Roadside Sanction and the disclosure in a Criminal Code impaired or over-.08 prosecution are very different, and what wins one can be irrelevant in the other. You have to know which law applies and how it applies to your specific facts.

One Note on Words, Because It Matters

If you searched for a "DUI lawyer", you're in the right place. DUI is the American term; Canada's Criminal Code calls these offences impaired driving, operation over the legal limit, and refusal. The police who stopped you, the Crown prosecutor handling the file, and the judge who hears it will all use the Canadian terms. This page uses both so you can find it, and the correct ones so you can use them.

— What is At Stake

What a Successful IRS Review is Actually Worth

People sometimes assume a roadside sanction is like a speeding ticket: pay it and move on. The math says otherwise. If your review succeeds, you do not pay the fine. Our office also files the paperwork to have the government reimburse your towing and impound fees.

Between the cancelled penalty, the recovered fees, and the insurance consequences that follow a sanction on your record, a successful review is routinely worth thousands of dollars, quite apart from getting you back on the road.

No outcome can be promised, and whether a review succeeds depends entirely on the facts and records in your case. What we can tell you is what we look for.

"If you contact us in time, the deadline becomes our problem instead of yours."

Frequently Asked Questions

Impaired Driving Questions, Answered Plainly

Is a DUI the same as impaired driving in Canada?

Functionally yes. DUI is the American term; the Criminal Code of Canada calls the offences impaired driving, operation while over the legal limit, and refusing a lawful demand. If you’re searching for a DUI lawyer in Edmonton, impaired driving defence is the service you’re looking for.

How long do I have to appeal an Immediate Roadside Sanction in Alberta?

7 days from the notice, including weekends and holidays. Barring exceptional circumstances, late applications will not be heard, which is why acting immediately matters more in IRS files than almost anywhere else in this area of law.

What happens if my IRS review is successful?

You do not pay the fine, and the government can be required to reimburse towing and impound fees, paperwork our office files as part of the review. Combined with the insurance consequences avoided, a successful review is often worth thousands of dollars.

Is an Immediate Roadside Sanction the same as a criminal charge?

No. An IRS is a provincial administrative penalty under Alberta’s SafeRoads program; a criminal charge proceeds under the Criminal Code through the courts. They have different procedures, different evidence, and different consequences, and some drivers face both at once.

Can a criminal impaired driving charge be reduced to a traffic ticket in Alberta?

Prosecution policies restrict resolving criminal impaired charges as traffic offences, so this rarely reflects reality. The realistic paths in an impaired file run through disclosure review, technical and Charter issues, and resolution discussions on the criminal charge itself.

What is the penalty for a first criminal impaired driving conviction?

Mandatory minimums scale with blood alcohol level: a $1,000 fine from .08, $1,500 from .12, and $2,000 at .16 or above, plus a minimum one-year driving prohibition and the ignition interlock program for full licence reinstatement. Higher penalties apply to repeat offences, including mandatory jail.

How fast will Liberty Law’s impaired driving lawyers respond if I contact you?

Normally within 24 hours of a consultation request, including weekends and holidays. IRS deadlines are the reason: with a 7-day window, waiting until Monday can cost a client their review.

Why Experience in This Specific Area Matters

Impaired driving has become one of the most technical areas of criminal law. Since the Supreme Court of Canada's ruling in R. v. Hufsky in 1988 set out the state's power to stop motorists, thousands of decisions on the stop, the demand, the testing procedure, and the Charter have shaped what a defence looks like. There are few open-and-shut impaired cases; there are files where the issues have been found and files where they haven't been looked for.

Our lawyers have run thousands of impaired driving trials at every level of court. Some of them have been defending these files since the 1990s, through every major change in the law. In any criminal trial there can be no guarantee of success, and you should be wary of any lawyer who promises one. What experience buys is something different: knowing every place a file can be won, and the judgment to tell you honestly which ones are open on your facts.
