Our client was accused of intentionally burning down his house, and his neighbors’ houses for insurance money. It was referred to Mr. LaValley by another lawyer as she felt unable to represent him due to the scope of the file. After reviewing disclosure, requesting additional disclosure and receiving disclosure, charter issues were highlighted including an unlawful search, and the length of time that the matter took to get to trial. Charter applications were heard approximately 3 months before the trial. The trial judge ruled that our client’s charter rights were breached and issued a stay of proceedings which terminated the prosecution.
