Our client was charged with sexual assault, and choking after a tinder date. The matter was initially scheduled for a jury trial. On the morning of trial there was an issue with the jury selection that led to a re-election to a Judge Alone. The Complainant testified and was subjected to cross-examination. Approximately half way through cross-examination the Complainant indicated that she needed a break. Mr. LaValley spoke with the Crown Prosecutor about the viability of the prosecution and the Crown Prosecutor indicated that they were no longer going to proceed. The Crown directed a stay of proceedings and the prosecution stopped.
