A woman went to the RCMP and reported that our client had sexually assaulted her 50 years earlier. She alleged that there were witnesses to the assault, but she had waited until they had all died before making her accusation. Our client denied the allegation, but because of the passage of time, had no memory of where he was or what he was doing at the time of the alleged incident. The court granted our application to have the charge dismissed, as the extreme delay in making the accusation made it impossible for our client to get a fair trial.
