Client was convicted after trial of sexual assault on a child. A member of his family referred him to our office for a potential appeal. Mr. LaValley obtained disclosure and noticed numerous procedural issues. Mr. LaValley attempted to speak with his initial lawyer who was resistant. Eventually Mr. LaValley brought a mistrial application to have the conviction set aside on the basis of ineffective assistance of counsel. The initial lawyer was called as a witness and disputed that she was ineffective. After cross-examination and argument, the trial Judge granted the application and ordered that there be a new trial.
